El presente documento establece los Términos y Condiciones de uso, compra y licenciamiento de los productos digitales comercializados a través de Andina Digital, plataforma operada por Andina Software S.A.C. (en adelante, «la Empresa» o «Andina Digital»), con domicilio en Lima, República del Perú.

Al registrarse, navegar o completar una compra en andina.digital, el usuario (en adelante, «el Cliente») declara haber leído, comprendido y aceptado íntegramente estos Términos y Condiciones, constituyendo un contrato vinculante conforme al artículo 141 del Código Civil peruano y la Ley N.° 27291.

Important: If the Client does not agree with any provision of this document, they must refrain from purchasing or using the products and services of Andina Software S.A.C.

2Subject matter

The Company sells plugins, extensions, modules and other digital products for WordPress, WooCommerce, Moodle and PHP environments (hereinafter, "the Products"). The Products are digital goods delivered immediately by electronic download and/or license key, in accordance with articles 1529 et seq. of the Peruvian Civil Code (sales contract) and the applicable e-commerce regulations.

The Company acts as a direct seller of its own products. It does not act as an intermediary or third-party marketplace. All products listed on the site are developed or licensed directly by Andina Software S.A.C.

3Formation of the electronic contract

The sales contract is concluded at the moment the Client completes the payment process and receives the order confirmation by email, in accordance with Law No. 27291 (which amends the Civil Code to allow the use of electronic means for the expression of intent). The Company will keep an electronic record of the order for the minimum period required by Peruvian tax regulations (five years).

The selection of a product and its addition to the cart do not constitute a binding offer until payment is confirmed. The Company reserves the right to reject an order for justified reasons, in which case a full refund of the amount paid will be processed.

4License

The acquisition of a Product grants the Client a personal, non-exclusive, non-transferable and non-sublicensable license of use, for the number of installations indicated in the purchased plan:

Single-site license: activation and use on one (1) active domain at a time.
Unlimited license: use on an unlimited number of domains owned or managed by the Client.

Plugins are distributed under the GNU General Public License v3.0 (GPL v3.0), which does not extend to graphic resources, logos, marketing texts, documentation or proprietary visual assets of the Company, which remain under the exclusive copyright of Andina Software S.A.C.

Expressly prohibited: It is strictly prohibited to resell, sublicense, commercially redistribute or transfer the license to third parties without prior written authorization from the Company. Breach of this clause will result in immediate revocation of the license without the right to a refund, and may give rise to civil and/or criminal liability under Legislative Decree No. 822.

5Pricing and payment

Prices are expressed in Peruvian Soles (S/) or US Dollars (USD), as indicated for each Product. They include the General Sales Tax (IGV) where applicable, in accordance with the Consolidated Text of the IGV and ISC Law (D.S. No. 055-99-EF). The Company is not responsible for any additional taxes or charges that may apply in the Client's country.

The Company accepts the following payment methods:

Credit or debit card: Visa, Mastercard and American Express. Payment is subject to subsequent approval by the issuing bank.
Digital wallets (Yape / Plin): payment via QR code. The order remains pending until payment receipt verification.
Cryptocurrencies: available only upon prior verification of an approved contract and authorization by the sales team.

The Company reserves the right to modify prices at any time. The applicable price is the one in effect at the time the order is confirmed.

6Electronic invoicing

The Company issues electronic payment receipts (Sales Receipt or Electronic Invoice) in accordance with SUNAT regulations (Superintendent's Resolution No. 097-2012/SUNAT and amendments). The receipt is sent to the Client's registered email address within a maximum of 72 business hours from payment confirmation.

For the issuance of an Electronic Invoice, the Client must provide their active RUC number and the corresponding Legal Name at the time of purchase. Invoices for foreign clients may be issued in USD according to the current exchange rate published by the Central Reserve Bank of Peru (BCRP) on the date of the transaction.

7Product delivery

Digital Products are delivered electronically and immediately upon payment confirmation, via:

Direct download link sent to the Client's email address.
License key and downloadable file available in the client area ("My Account") of the site.

Since delivery is immediate and access to the Product is enabled upon payment confirmation, the Client is responsible for verifying that their email address is correct before completing the purchase. The Company is not responsible for errors in the delivery details provided by the Client.

8Technical support

Technical support is available during the term of the acquired license, via the site ticket system or by email at [email protected]. The standard response time is 24 business hours (Monday to Friday, 9:00 a.m. – 6:00 p.m., Lima time).

Technical support covers exclusively:

The proper functioning of the Product as described in its official documentation.
Resolution of errors or bugs attributable to the Product's code.
Guidance on installation and basic configuration.

Technical support does not include:

Custom code, design or functionality modifications.
Resolution of conflicts caused by third-party plugins or themes.
Support for versions of WordPress, Moodle or PHP below those specified in the Product requirements.
Data recovery or backups.

9Updates

Product updates are included during the term of the acquired license. Updates may include security fixes, compatibility with new platform versions and functional improvements.

The Company reserves the right to modify, update or discontinue any Product, notifying the Client at least 30 days in advance by email in the event of permanent discontinuation. Discontinuation does not entitle the holder to a refund for already active licenses that remain operational.

10Refund policy

In accordance with the Consumer Protection and Defense Code (Law No. 29571) and INDECOPI guidelines, the Company offers a money-back guarantee within 7 calendar days following the purchase date, exclusively when all of the following conditions are met:

The Product does not function as described in its official documentation.
The technical support team has been unable to resolve the reported issue within a reasonable timeframe.
The Client has cooperated with the technical diagnostic process.
It is the Client's first refund request for the same Product and order.

Refund is not available in the following cases: change of mind; incompatibility with platform versions below the stated minimum requirements; conflicts caused by third-party plugins or themes; requests submitted outside the 7-day period; or if the Client has already received a prior refund for the same Product.

11Intellectual property

All intellectual property rights in the Products, brands, logos, trade names, texts, images and other site content are the exclusive property of Andina Software S.A.C., protected by Legislative Decree No. 822 (Copyright Law), trademarks registered with INDECOPI and the international intellectual property agreements signed by Peru.

The plugin source code is distributed under GPL v3.0, which grants the Client the right to use, study and modify the code for personal use. However, the trademarks "Andina Software", "Andina Digital" and their logos are not part of the GPL and may not be reproduced, modified or used without the express written authorization of the Company.

12Limitation of liability

The Products are provided "as is" and in accordance with their official documentation. The Company does not warrant that the Products will be uninterrupted, error-free or compatible with every technological environment. In accordance with article 1321 of the Peruvian Civil Code, the Company shall not be liable for:

Indirect, incidental, special or consequential damages arising from the use or inability to use the Product.
Loss of data, revenue, profits or business opportunities.
Compatibility issues with technological environments other than those specified in the minimum requirements of the Product.
Damages caused by incorrect use, unauthorized modification or installation of the Product outside the terms of the license.

The Company's maximum liability to the Client, for any cause, is limited to the amount actually paid for the license of the affected Product.

13Protection of personal data

The processing of the Client's personal data is governed by Law No. 29733 (Personal Data Protection Law) and its Regulations (D.S. No. 003-2013-JUS). The Company is the data controller registered with the National Authority for Personal Data Protection of the Ministry of Justice and Human Rights of Peru.

The Client's personal data is collected and processed exclusively for: (i) order management and Product delivery; (ii) issuance of the payment receipt; (iii) provision of technical support; (iv) sending communications related to the acquired license. The Company does not sell or transfer personal data to third parties for commercial purposes.

The Client may exercise their ARCO rights (Access, Rectification, Cancellation and Opposition) by contacting [email protected], attaching a copy of their identity document. For more information, please consult our Privacy Policy.

14Amendment of terms

The Company reserves the right to modify these Terms and Conditions at any time, publishing the updated version on this page with an indication of the date of the last update. Modifications will take effect from the date of publication.

For purchases already made, the conditions in force at the date of the order shall apply. Continued use of the site or the Products after publication of the new terms implies acceptance of such terms for future purchases.

15Governing law and jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Peru. For any dispute arising from the performance, interpretation or breach of this agreement, the parties expressly submit to the jurisdiction of the Courts and Tribunals of the city of Lima, Peru, waiving any other jurisdiction that may apply to them.

Without prejudice to the foregoing, the Client has the right to file complaints with the INDECOPI Consumer Service, in accordance with Law No. 29571 (Consumer Protection and Defense Code), and with the available online dispute resolution mechanisms.
